The conditions of the Draw.

The period of the event: from 01.10.2022 to 15.11.2022.

I. General provisions.

The name of the promotion: "Birthday of the Alma-Ata Shopping Center" (hereinafter referred to as the "Draw").
The organizer of the Drawing: Limited Liability Partnership "Alma-Ata Shopping Center" (hereinafter referred to as the "Organizer").
The territory of the Draw: TD Alma-Ata, address: Republic of Kazakhstan, Astana, Imanova str., 19.
The total duration of the Draw is from October 01, 2022 from 10.00 to November 15, 2022 to 17.00 inclusive (hereinafter referred to as the "Draw Period"). The period of the Draw can be changed by the Organizer of the Draw without additional notification, provided that information about the change is posted on the official website of the Organizer or on official pages on social networks. The preliminary completion of the Drawing cannot serve as a reason for claims.
Citizens of the Republic of Kazakhstan and foreigners who have reached the age of 18 and adults with a residence permit in the Republic of Kazakhstan who have made a purchase (hereinafter referred to as Participants) have the right to participate in the Drawing.
Employees of the Organizers of the Drawing, tenants of the Alma-Ata trade House and their sellers and stateless persons cannot participate in the Drawing.
If the Participant does not meet the requirements of paragraph 5. of these Rules, such persons will be excluded from the winners.
Receipts of all shops and storefronts presented at the Alma-Ata Trade House participate in the Drawing.
The Draw is open to Participants who have filled out one or more coupons (the total number of coupons per participant should not exceed five coupons).
The Draw does not include: checks with transactions for cancelled/ refundable purchases; transactions related to replenishment of mobile phone and bank card accounts, payment for Internet, TV, utility bills, payment for services not provided on the territory of the Alma-Ata Trading House.
Within the framework of the Drawing, prizes are awarded, the names of which are indicated in paragraph 2.
Additional information about the Draw is indicated on the official website of the Organizer www.marden.kz , or on the official pages of the Organizer on social networks @alma_ata_td
These rules (hereinafter referred to as the "Rules") come into force on October 1 from 10:00 a.m. Astana time.

II. The prize fund of the Draw.

As part of the draw, prizes are awarded at the discretion of the Organizer.
There is no payment of the monetary equivalent of the prize value instead of giving out prizes or replacing them with other prizes.
Claims regarding the quality of prizes must be made directly to the producers of these prizes. The integrity and functional suitability of the prizes must be checked by the participants of the Drawing immediately upon receipt of the prize. The appearance of the original prizes may differ from their images shown in the promotional materials.
The Organizer's obligations to award prizes to the participants of the Draw are limited to the prize fund specified in clause 2.1. The number and names of prizes can be added to these Rules at any time from October 1, 2022 to November 15, 2022 by the Organizer of the Draw.
All amounts not spent during the validity period of the certificates will be cancelled after their expiration date.
Persons who have expressed a desire to be sponsors of the Drawing must agree on the design of certificates with the Organizer of the Drawing by October 15.
After this deadline, sponsorship applications will not be considered.

III. The conditions of the Draw.

To participate in the Drawing, you must:

To purchase a product or service in the Alma-Ata trading house in the amount of 15,000 (fifteen thousand) tenge or more. In addition, if the total amount of checks is 15,000 tenge or more, this buyer can also participate in the Drawing. The payment must be made in cash to the cash desk of the tenants of the Alma-Ata Trading House or by non-cash method with the mandatory receipt of a payment document. At the same time, money transfers via the application Kaspi.kz applications and/or services are not accepted as confirmation of purchase of a product or service.
Get a fiscal receipt issued by the tenants.
Bring the receipt/ receipts of the purchased goods or services to the Alma-Ata Trading House to the office of the Alma-Ata Trading House administration. Opening hours for the exchange: from 10.00 – 20.00 h. from 01.10.2022 until 11/14/2022, and 11/15/2022 until 17.00 h., excluding the time from 13.00 to 14.00 on working days and completely Saturday and Sunday.
After submitting the receipt, you must receive a coupon from the Administrator of the Alma-Ata Trading House, indicate in block letters: the date of filling, full name, date of birth, IIN mobile phone number, boutique/ showcase number, name of the purchased product or service and put a signature confirming participation in the Drawing, familiarization and agreement with these The rules of the Draw. The participants acknowledge, declare and agree that all the information they provided in the registration form is correct and reliable. The receipt remains with the Organizer.
The organizer has the right to exclude the coupon from the drawing in case of incorrect filling, if the data is crossed out and adjustments are made, and in other cases provided for by these Rules and the legislation of the Republic of Kazakhstan.
By accepting the Rules of participation in the Drawing, the Participant of the Drawing expresses his consent to the use of the Participant's personal data, to use (publication, reproduction, distribution) images of the Participant by the Organizer or third parties attracted by him for advertising purposes, without paying any remuneration or compensation to the Participants and without time limits.
Coupons are issued exclusively by the representative of the Organizer of the Drawing. Coupons are registered and cannot be transferred to another person. Lost coupons cannot be restored or refunded.
Visitors who made a purchase during the Drawing period in the amount of 15,000 (five thousand) tenge or more receive 1 (one) coupon, that is, for every 15,000 tenge – 1 coupon. For example, for the amount of 30,000 (thirty thousand) tenge – 2 coupons, for the amount of 45,000 (forty-five thousand) tenge – 3 coupons, but no more than 5 (five) coupons if the amount of checks exceeds 75,000 (seventy-five thousand) tenge. The time and date of purchase are indicated on the receipt.
The minimum total amount of checks from one buyer participating in the Drawing is 15,000 (fifteen thousand) tenge.
The prize draw will take place on November 15, 2022 from 18:00 to 21:00. Astana time on the 1st floor, food court TD, at the address: Republic of Kazakhstan, Astana, Imanova str., 19. The winners of the Draw will be determined by random selection from filled coupons in the lottery.
The winner can win 1 grand prize, at the next prize draw, the coupons of the winning Participants do not participate in the draw.
If the participant of the drawing has won a prize and is physically absent when the results are announced, the event host calls him at the contacts specified in when filling out the coupon. If it was not possible to notify the participant of the drawing by calling, the prize is played again.
To participate in the drawing, you must have a detachable part of the coupon with the number, the original identity document. The personal data in the coupon and the UDL must match.
In case of non-compliance by the Participant with clauses 3.11., 3.12., the Organizer conducts a repeat prize draw.
Upon receipt of the prize, the winner must sign the Acceptance Certificate, which will indicate his/her personal information and information about the prize.
From the moment of receiving the prize, its holder is tax responsible for paying all applicable taxes and other existing mandatory payments in accordance with the current legislation of the Republic of Kazakhstan. All disputes concerning this Drawing are regulated in accordance with the current legislation of the Republic of Kazakhstan.
From the moment the prize is received by the Participant of the Drawing, the latter bears the risk of its accidental loss or damage (death, damage).
The organizer of the Drawing is not responsible for:
non-receipt / untimely receipt of information necessary to receive the prizes of the Draw, due to the fault of the Participants themselves or due to the fault of communication organizations or for other reasons beyond the control of the Organizer;
non-fulfillment (untimely fulfillment) by the participants of the Drawing of the obligations provided for by these Rules;
non-receipt by the winners of the Prize Draw in case of non-demand or refusal of them;
life, health, for moral and/or mental injuries of the Participants of the Drawing, in connection with their participation.
Attention! After receiving the prize, the pick-up rule applies. All transportation costs are borne by the Participant of the Drawing.

IV. Other conditions.

The images of the prizes (models, color and size) placed in the promotional materials may differ from the actual prizes.
All Participants of the Drawing, taking part in it, agree with the rules of the Promotion, commit themselves to adhere to and comply with them. If a Participant violates the Rules of the Draw and or commits an act of fraud and/or deception to receive a prize, he loses the right to receive a prize.
The Organizer does not assume any obligations to inform the winners of the Draw individually and/or deliver the prizes to the winners' place of residence.
In case of any claims against the Organizer by third parties in connection with the violation by the Participant of the rights of third parties during the Drawing, the Participant assumes responsibility for the independent resolution of such disputes.
The results of the Drawing are final and are not subject to revision.
The Organizer has the right to change and supplement these Rules and the list of prizes without the prior consent and notification of the Participants.
The Organizer is not responsible for postponing the dates of the Draw and other changes caused by circumstances beyond its competence.
The Organizer has the right to refuse to register a Visitor as a Participant in the Drawing in the following cases:
if the date of the receipt / receipts does not correspond to the period of the Drawing;
the visitor does not meet the requirements for the Participant of the Drawing;
in case of assignment by the Participant of someone else's cash receipts, which already have the mark of the organizer of the Drawing and / or checks that do not participate in the Drawing or other inconsistency of the checks provided by the Participant with the conditions of these Rules.
The Organizer has the right to refuse to award the prize to the winner of the Drawing if it is established that he has violated these Rules.
The Organizer has the right to refuse to consider a claim to a Participant in the Drawing in connection with non-receipt of a prize in case of non-compliance or violation of these Rules by the Participant of the promotion.
The participant of the Drawing is not recognized as the winner of the prize if the Organizer identifies the Participant's actions not related to personal purchases, but aimed solely at participating in the Drawing, this is the collection of receipts from purchases made by third parties.
The Organizer does not award prizes in case of detection of the above facts, including fraud of the Participant in the process of participating in the Drawing, in case of falsification and other violations during participation in the Drawing. The Organizer determines the existence of fraud, falsification and other violations at its discretion.
The Organizer is not responsible for the non-receipt by the Participants of the Prize Draw in case of non-demand by the Participants or refusal of them.
If the Participant who became the winner of the prize refuses to receive the prize, or the Participant does not comply with the requirements of these Rules, the Organizer has the right to transfer the prize to another Participant at its discretion, or dispose of the prize in another way that does not contradict the current legislation of the Republic of Kazakhstan.
